Bequest Language
Alumnae and friends who wish to provide for Winsor under their wills will
want to know that such a gift may be accomplished in a number of ways:
Specific Bequest
- A bequest of a specific dollar amount [“I
give, devise and bequeath the sum of $_________ to the Trustees of the Winsor
School, Pilgrim Road, Boston, Massachusetts, to be used in the following manner:
__________."]
- A bequest of a specific asset [“I give to the Trustees
of the Winsor School, Pilgrim Road, Boston, Massachusetts all of my right,
title, and interest in the following: (description of property)_______________________________."]
Residuary Bequest
- A residuary bequest of all or a portion of an estate after
the payment of specific amounts to other beneficiaries. [“I give,
devise, and bequeath the residue of the my estate, real and personal, as follows: A
_____ percent (%) thereof shall be distributed absolutely to the Trustees of
the Winsor School, Pilgrim Road, Boston, Massachusetts to be used in the following
manner:_________________."]
Contingent Bequest
- Should (name of individual) predecease me, then I direct that my executor provide that her/his interest shall be made payable to the Trustees of the Winsor School, Pilgrim Road, Boston, Massachusetts.
Gifts to Winsor under a will may be given for the unrestricted use of the Trustees,
used to support a particular program, or added to endowment.
In balancing the wish of the donor to benefit a special purpose with Winsor’s
need to meet ever-changing financial needs, advisors recommend that restrictions
be described as broadly as possible, avoiding detailed limitations. The
more limited the restrictions of such a bequest, the more important it is to
add a provision such as the following:
“In the event that such use should prove to be impracticable or undesirable
for any reason as the Trustees may determine, in their sole discretion, they
shall then provide for alternative uses of the fund in a manner consistent with
and reflecting the spirit of the original gift.”
